NFA grants license to FX hedge fund after previous denial

This decision has been over turned by the regulators based on a settlement offer which consists of 11 conditions. As the NFA grants license to FX hedge fund, strict conditions have to be strictly adhered by the hedge fund in its business operations.

The reason for the initial denial of the license is based on James T. Sherwin’s issues with the NFA 25 years ago. James T. Sherwin is the principal and owner of 80Plus LLP. The US regulators stated that in the United States District Court for the District of Columbia, around the 8th of March 1990, dealing with the Securities and Exchange Commission v. GAF Corporation and Mr. James T. Sherwin, a Final Judgment of Permanent Injunction (Settlement) was entered. The corresponding Case No. of the ordeal is 90-0527. Resultantly, Mr. Sherwin was permanently enjoined from violating Section 10(b) of the Securities Exchange Act of 1934 (Exchange Act) and Exchange Act Rules 10b-5 and 13b2-1 and from aiding and abetting violations of Exchange Act Sections 13(b)(2)(A) and l3(d)(2) and Exchange Act Rule 13d-2.

The decision to now grant 80Plus LLC a license was made last week. Mr. Sherwin explained the change in circumstances: “On 26 January, the NFA issued a Withdrawal of Notice of Intent and a Final Order Granting Conditional Registrations. I had previously obtained the necessary approvals from the Financial Conduct Authority (FCA) on this side of the water. My hedge fund, 80Plus Partners, started up on 1 April.”

In a further comment Mr. Sherwin concluded the following: “I am the principal investor for the first month with just under $5 million but I expect to be at about $10 million by 1 May. The hedge fund will principally do foreign exchange in which I have been active for over 50 years. I think it is probably the only hedge fund of which the active principal is 80+ and one of my three directors is also over 80″.
